Frequently Asked Questions
What should I do when I am first charged?
Stay calm and exercise your right to silence until you have spoken with a lawyer. You are entitled to legal advice before answering police questions. Early advice can help clarify the charge and protect your position from the outset.
How should I prepare for court in Campbelltown?
Know your court date, understand the charge and seek legal advice early. Bring your Court Attendance Notice, bail documents and any relevant evidence. Arrive early at Campbelltown Local Court and dress appropriately. Be prepared to wait, as matters are often called later in the day.

A guilty plea may proceed to sentencing, while a not guilty plea will be listed for hearing. More serious offences may later proceed to the District or Supreme Court.
What is a Section 10 dismissal?
A section 10 dismissal occurs when a court finds a person guilty but does not record a conviction. It may be granted section 10 of the Crimes (Sentencing Procedure) Act 1999, depending on the circumstances. In some cases, the court may also impose a conditional release order instead of recording a conviction.
Can police search my property without a warrant?
Police usually require a warrant, but there are limited circumstances where a search can occur without one under the Law Enforcement (Powers and Responsibilities) Act 2002 (NSW). If evidence is obtained unlawfully, it may be excluded under section 138 of the Evidence Act 1995 (NSW). Legal advice should be sought if you have concerns about a search.
How does bail work in Campbelltown?
Bail determines whether you remain in the community or are held in custody while your matter is ongoing. If police refuse bail, an application can be made in Campbelltown Local Court under the Bail Act 2013 (NSW). The court considers risk factors and may impose conditions such as reporting or curfews.
