Challenge

Jones Hardy Law represented a client in the District Court of New South Wales facing multiple serious criminal charges, with the matter proceeding to a jury trial lasting approximately four weeks.

Prior to trial, the client entered a plea of guilty to one count, while maintaining his innocence in respect of the remaining charges. The case was complex, factually contested, and carried the real prospect of a lengthy custodial sentence if convicted.

The client had been in custody leading up to and during the trial, and the outcome of the proceedings would determine both his immediate liberty and long-term future.

Advising on and facilitating an early plea of guilty to the appropriate charge, thereby demonstrating acceptance of responsibility where warranted

Solution

Following the four-week jury trial, the client was found Not Guilty of the remaining charges.

On the same day as the verdict, Jones Hardy Law successfully made an application for bail, with the Court ordering the client’s immediate release from custody.

The client then proceeded to sentencing in respect of the single offence to which he had pleaded guilty. The Court imposed a sentence of time already served, meaning that no further custodial penalty was required.

This outcome ensured that the client was released immediately and avoided any additional time in custody, notwithstanding the seriousness of the proceedings.
