Privacy Policy

1. About This Policy and Who We Are

Our websites are operated by N.P Hardy-Clements & A.M Jones Partners trading as Jones Hardy Partners (ABN 37 240 944 675). In this policy, “Jones Hardy Law”, “we”, “us” and “our” mean that partnership.

This policy explains how we handle personal information. It covers information we collect through our website, joneshardylaw.com.au, and information we collect while providing our legal services.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. What Personal Information We Collect

The information we collect depends on why you contact us and on the work we do for you. It may include:

  • your name, phone number, email address and postal address
  • details about your legal issue, including court dates and the people involved
  • information about your matter that you or others give us while we act for you
  • financial information, such as information needed for billing or a Legal Aid application
  • identity documents, where we need to confirm who you are

Our work covers criminal law, traffic law, family law, AVO and domestic violence matters, civil law and Legal Aid matters. Because of this, we often collect sensitive information. Sensitive information is a category the Privacy Act gives extra protection. For us, it most often means:

  • criminal history, including charges, convictions and court outcomes
  • health information, such as medical reports, mental health information, or injuries relevant to your matter

Where a matter requires it, we may also collect other sensitive information, such as information about your racial or ethnic origin or your sexual orientation or practices. We collect sensitive information only with your consent, or where the law allows it.

Some of the other information we hold, such as financial details and information about your family and relationships, is not sensitive information as the Privacy Act defines it. It is still confidential, and we handle it that way. Information about a family matter often contains health information, and we treat it as sensitive to that extent.

When you visit our websites, we also collect information about your visit. The section Cookies and Website Analytics explains this.

3. How We Collect It

Most of the information we hold comes directly from you, when you:

  • fill in an enquiry or contact form on our websites
  • book a call with us through our online booking tool
  • phone or email us, or meet with us
  • give us information and documents while we act for you

Calls to our main number, (02) 7257 0384 , are recorded through our call tracking provider, Delacon, and a message at the start of each call tells you so. We use the recordings to follow up enquiries, check the quality of our service and keep a record of what was discussed.

Sometimes we collect information from other people because your matter requires it. They include courts and tribunals, police and prosecutors, Legal Aid NSW, other parties and their lawyers, and experts or report writers.

We also collect some information automatically when you use our websites, through cookies and the tools described in the section “Cookies and website analytics”.

You can make a general enquiry without giving your name. We cannot act for you anonymously, though, because we need to know who you are to give you advice and to check for conflicts of interest.

4. Why We Collect It

We collect, hold, use and disclose personal information to:

  • respond to your enquiry and decide whether we can help
  • give you legal advice and act for you in your matter
  • manage our relationship with you, including billing
  • understand how people use our websites and improve them and our services
  • meet our legal and professional obligations as solicitors

We also use and disclose personal information for other purposes where you have agreed, or where the law requires or allows it.

We do not send marketing emails. If we start a newsletter, we will send it only to people who ask for it, and every issue will let you unsubscribe.

5. Who We Share It With

We share personal information only as needed for the purposes above. Depending on your matter, that may include:

  • barristers and other lawyers who work on your matter
  • experts and report writers
  • courts and tribunals
  • police and prosecuting authorities, where your matter requires it
  • Legal Aid NSW, where you apply for or receive legal aid
  • other parties and their lawyers, where your matter requires it
  • service providers who help us run the firm, such as IT, practice management software (Smokeball) and accounting providers, and Zapier, which passes the enquiries you send through our websites into those systems

We also disclose personal information where the law requires or authorises it, such as under a court order.

6. Overseas Disclosure

We are likely to disclose personal information overseas. Some of the service providers we use, including our website analytics provider, store information overseas, including in the United States.

7. Cookies and Website Analytics

When you visit our websites, we and the companies whose tools we use collect information about your visit. This includes the pages you view, how long you stay, the device and browser you use, your approximate location, and how you found us, such as the search engine or website that sent you.

Cookies are small files that a website stores in your browser. They let the site remember things about your visit. Similar technologies, such as your browser’s local storage, work in much the same way. In this section, “cookies” covers both. Some cookies are set by us. Others are set by the companies whose tools we use.

The Google reviews on our website are copied from Google when we update the site, so no review tool runs in your browser there.

Some of these tools set cookies or use similar technologies in your browser.

Some of the information these tools collect can identify you, particularly when it is linked to a form you submit, a call you make or a booking. We handle it in accordance with this policy.

You can block or delete cookies at any time in your browser settings, and most browsers let you block cookies from one site or from all sites. If you block cookies, some parts of our websites, such as the booking tool, may not work properly.

8. How We Hold and Protect It

We hold personal information in electronic systems and, where needed, in paper files. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, change or disclosure.

We keep personal information for as long as we need it, and for as long as the law and our professional obligations require us to keep client files. When we no longer need it, we take reasonable steps to destroy it or remove the details that identify you.

9. Access and Correction

You can ask to see the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Contact our Privacy Officer using the details in the section Contact Us. We will respond within 30 days.

We may refuse some access requests where the law allows it. For example, we may withhold information that is protected by legal professional privilege (the rule that keeps certain legal communications confidential) belonging to someone else, such as another client or another party, or information about a legal dispute between you and us, or where giving access would breach a duty we owe to a court. If we refuse, we will tell you why in writing.

There is no charge to ask for access. If giving you access takes significant time or copying, we may charge a reasonable fee, and we will tell you before we do.

10. Complaints

If you think we have mishandled your personal information, please contact our Privacy Officer:

We will acknowledge your complaint and respond within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
