Frequently Asked Questions

Where is the family court in Parramatta?

The Federal Circuit and Family Court of Australia’s Parramatta registry is in the Garfield Barwick Commonwealth Law Courts Building, 1-3 George Street, Parramatta NSW 2150. It is a short walk from Parramatta Station.

Do I have to go to court to sort out parenting arrangements?

Not usually. Most parents reach an agreement, often through family dispute resolution, and can record it in a parenting plan or ask the Court to make consent orders. Before you apply to the Court for parenting orders, you generally need a certificate showing you have attempted family dispute resolution, unless an exception applies, such as family violence or urgency.

How long do I have to apply for a property settlement?

If you were married, you must apply within 12 months after your divorce order takes effect. If you were in a de facto relationship, you must apply within two years after the relationship ended. After that, you need the Court’s permission, so get advice early.

When can I apply for a divorce?

You can apply once you have been separated for at least 12 months. If you have been married for less than two years, you also need to show that you have considered reconciliation with the help of a family counsellor, or ask the Court’s permission to apply without it.
